1. The CENIEH whistleblower channel is an internal one, which is part of the entity's internal reporting system in compliance with the demands of the Act 2/2023 on the protection of persons who report regulatory infringements or those related to the fight against corruption.
2. The collaboration of everybody who participates in any way in the management and pursuit of the activities of the CENIEH renders indispensable not just personal compliance by each with their own obligations, but also commitment to the proper functioning of the Center.
3. For this reason, the CENIEH makes the whistleblower channel available to all persons involved in its proper operation. In other words, the whistleblower channel is available for:
a. Persons who are employees or freelance workers;
b. Participants and persons belonging to the administrative, management or supervisory bodies of the organization, including non-executive members;
c. Any person who works for or under the supervision and direction of contractors, subcontractors or providers;
d. Those who communicate or reveal publicly information about infringements obtained under the auspices of an employment or officer relationship already concluded, volunteers, interns, workers undergoing training, whether or not they are remunerated, as well as all those whose employment relationship has not yet commenced, in cases where the cited information were obtained during the process of selection or precontractual negotiation.
4. The exclusive purpose of the whistleblower channel is for the reporting of the following conducts, provided that they are performed in the name or on behalf of the CENIEH, or in the course of the activities of the CENIEH, or on the occasion of the same:
Actions or omissions which could constitute a serious or very serious felony or administrative infringement. This shall in any case be construed to cover at least all serious or very serious felonies or administrative infringements which entail any loss to the Hacienda Pública or for the Seguridad Social.
Actions or omissions which could constitute infringements of European Union law in matters such as public procurement, Financial services, products and markets, and the prevention of money laundering and the financing of terrorism, product safety and conformity, transport safety, environmental protection, protection against radiation and nuclear safety, food and animal feed security, animal health and welfare, public health, consumer protection, Protection of privacy and personal data, network and IT system security; or those affecting financial interests of the Union, or those impinging on the internal market, including infringements of the Union's rules on competition and state aid, as well as those acts impinging on the internal market that breach the rules on corporation tax, or practices whose objective is to obtain a tax advantage which thwart the objective or purpose of the legislation on corporation tax.
Actions or omissions which could constitute a breach of the internal rules or procedures which the CENIEH has in place to control the risks of fraud, corruption or conflicts of interest, or other risks of serious or very serious regulatory breaches.
